Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the BeCreator platform, website, and services (collectively, the "Service") operated by Agen Digital LLP ("BeCreator", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using BeCreator, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

To use certain features, you must create an account. You agree to provide accurate and complete information, keep your credentials secure, and notify us immediately of any unauthorized access. You are responsible for all activity that occurs under your account.

3. Services

BeCreator provides an all-in-one platform for content creators, including:

  • Link In Bio — Customizable landing pages to showcase your links and content.
  • Instagram Auto DMs — Automated direct messaging tools for audience engagement via Instagram's official Graph API.
  • Bookings — Scheduling and appointment management for your services.
  • Forms — Custom form builder for collecting information from your audience.
  • Analytics — Performance tracking and insights for your creator business.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

4. Instagram and Third-Party Platform Compliance

By connecting Instagram or any third-party platform account to BeCreator, you agree to comply with that platform's terms, policies, and guidelines, including:

By connecting an Instagram account to BeCreator, you represent and warrant that you are the authorized owner or administrator of that Instagram Business account and that you have the authority to grant BeCreator the permissions requested during the OAuth connection process.

You are solely responsible for the content of your automated messages and the way you configure and use the Auto DM feature.

You must NOT use BeCreator's Instagram features to:

  • Send spam, bulk unsolicited messages, or deceptive content via Auto DMs
  • Send misleading content or use deceptive links in automated messages
  • Impersonate another person, brand, or entity
  • Violate Instagram's Community Standards or any applicable Meta policy
  • Circumvent, disable, or interfere with Meta's platform restrictions or safety systems
  • Attempt to complete sales transactions or process payments inside Instagram Direct Messages — all commerce must occur on becreator.app or your own external pages
  • Use Message Tags or any other mechanism to send promotional or marketing messages outside of Meta's permitted messaging windows
  • Use the Auto DM feature for any purpose other than legitimate creator-audience engagement

BeCreator reserves the right to suspend or disconnect your Instagram integration immediately — without suspending your entire BeCreator account — if your usage of Instagram-related features violates Meta's policies or creates enforcement risk for BeCreator or other users on the platform. BeCreator may cooperate with Meta on enforcement actions, data requests, or platform audits as required.

5. Creator Responsibilities for Automated Messaging

When using BeCreator's Auto DM features, you are responsible for:

  • Truthful and non-deceptive messages: Ensuring all automated messages are accurate, not misleading, and do not make false claims.
  • Opt-in style calls to action: Using calls to action that make clear to your audience that commenting or replying will result in receiving a DM (e.g., "Comment GUIDE below and I'll DM you the link"). Your audience should not be surprised by receiving an automated message.
  • Respecting opt-outs: Honoring all opt-out requests. Do not attempt to re-engage users who have sent "STOP" or otherwise opted out of your automations. Do not circumvent BeCreator's opt-out system.
  • Lawful basis for messaging: Warranting that you have a lawful basis to send automated messages to the members of your audience who trigger your automations, and that your use of the feature complies with applicable laws (including anti-spam and data protection laws in the recipient's jurisdiction).
  • Content compliance: Ensuring the content of your automated messages, including any links and media, does not violate Instagram's Community Standards or any applicable law.

6. User Content

You retain ownership of all content you create, upload, or share through the Service ("User Content"). By using the Service, you grant BeCreator a non-exclusive, worldwide, royalty-free license to host, display, and distribute your User Content solely for the purpose of operating and providing the Service.

You represent and warrant that your User Content:

  • Does not violate any applicable law or regulation
  • Does not infringe on any third-party intellectual property rights
  • Does not contain harmful, abusive, or misleading material

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.

7. Payments and Billing

Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. All payments are processed through Paddle, our Merchant of Record.

  • Subscriptions renew automatically unless cancelled before the renewal date.
  • Refunds are handled in accordance with our refund policy, available upon request.
  • We may change pricing with at least 30 days' notice before your next billing cycle.

8. Intellectual Property

The Service, including its design, features, code, trademarks, and branding, is owned by Agen Digital LLP and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.

9. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Transmit malware, spam, or other harmful content
  • Impersonate another person or misrepresent your affiliation with any entity
  • Use the Auto DM feature to send unsolicited promotional messages outside of Meta's permitted messaging policies or windows
  • Misuse Instagram Message Tags or messaging templates to send advertising or promotional content in ways that violate Meta's policies
  • Attempt to process sales or collect payments inside Instagram Direct Messages
  • Scrape, harvest, or collect personal information about other users or DM recipients beyond what is provided through BeCreator's features

10. Data on Disconnection and Account Deletion

Disconnecting Instagram

When you disconnect your Instagram account from BeCreator, we will: revoke and delete your stored access token; delete the Instagram account record and cached profile data; and delete associated automation data including triggers, conversation records, message logs, queued jobs, and end user data linked to that Instagram connection.

Deleting Your BeCreator Account

When you request deletion of your BeCreator account, a 14-day grace period begins. During this period, you can cancel the request and retain your account. After 14 days, all data associated with your account will be permanently deleted, including: your profile and account information; all Instagram connections and related data; automation configurations; conversation and message histories; booking and event data; form responses; and collected email lists. We may retain billing records and data required for legal or financial compliance obligations for the period required by applicable law.

Surviving Provisions

The following sections survive termination of your account: Section 8 (Intellectual Property), Section 13 (Limitation of Liability), Section 14 (Indemnification), and Section 15 (Governing Law).

11. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that is harmful to other users or the Service.

We may also suspend or terminate your access to Instagram-related features specifically — without terminating your entire BeCreator account — if your use of those features violates Meta's policies, our Terms, or creates platform risk for BeCreator or its users.

You may close your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately, and we will delete your account data as described in Section 10.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

BeCreator is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or Instagram. Instagram is a trademark of Meta Platforms, Inc. Use of BeCreator's Instagram features is subject to Instagram's and Meta's own terms and policies, and BeCreator is not responsible for changes to those platforms or any enforcement actions taken by Meta.

13. Limitation of Liability

To the maximum extent permitted by law, Agen Digital LLP and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of revenue, loss of data, or disruption of Instagram automations. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Agen Digital LLP and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: your use of the Service; your violation of these Terms; your violation of any third-party rights (including Meta's Platform Terms); or the content of your automated messages.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. For material changes, we will notify you by email or through a notice on the platform. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
